Neither the execution of this agreement nor the provision your Submission(s) will be deemed to place NMP or any NMP Affiliate in a different position than any one else to whom you have not provided your Submission with respect to any portion of the Submission that is not protectable literary property. You agree that NMP may keep all materials sent to NMP as part of your Submission, and you agree to retain at least one copy of such materials and release NMP from: any and all liability for loss of, or damage to, the copies of the materials submitted by you hereunder.

If` it is determined by the arbitrator that NMP or any NMP Affiliate improperly exploited the Submission or any part thereof without your consent, or has infringed upon your copyright, trademark or other rights in the Submission or other materials you provided to NMP, you agree that the sole remedy the arbitrator can award against NMP and/ or any NMP Affiliate will be a monetary award in the amount that NMP has paid for the similar exploitation of comparable material, or, if NMP has not previously exploited comparable material, an amount equal to a standard fee in the ad supported on line exhibition market for such material. Accordingly, you expressly waive any right to any other form of relief; including but not limited to injunctive relief, punitive damages and/or any alternate calculation of damages,

The prevailing party in any such arbitration will be entitled to recover its costs and expenses, including reasonable outside attorneysÃ¢ÂÂ fees and expertsÃ¢ÂÂ fees, which may be incurred in connection with such arbitration.
